These Website Terms of Use (the "Terms") constitute a binding agreement between you ("you" or "User") and The Existence Collective, LLC ("The Existence Collective," "we," "us," or "our") governing your access to and use of the website located at www.existencecollectivenh.com and any related content, tools, and features (collectively, the "Website"). By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Website.

1.  Informational Purpose Only; No Medical Advice

The content on the Website — including text, graphics, articles, blog posts, and other materials — is provided for general informational, educational, and self-reflective purposes only. It does not constitute medical, psychiatric, psychological, therapeutic, or legal advice, and it is not a substitute for professional evaluation, diagnosis, or treatment by a qualified provider. 2.  No Provider–Patient or Therapist–Client Relationship

Your use of the Website — including browsing its content, reading materials, submitting a contact or inquiry form, requesting an appointment, or otherwise communicating with us through the Website — does NOT create a therapist–client, counselor–client, provider–patient, or any other professional treatment relationship between you and The Existence Collective or Aoife Kennedy, LCMHC. A clinical relationship is established only after we have completed our intake process, verified eligibility, obtained your informed consent, and expressly agreed in writing to provide services to you. Until then, no clinical relationship exists and no duty of care arises from your use of the Website.

End-of-Life Care vs. counseling. The Existence Collective offers both licensed clinical counseling and non-medical end-of-life care, wellness, and educational services. End-of-life care and educational offerings are not therapy, do not involve the diagnosis or treatment of any mental-health condition, are not covered by insurance, and do not create a therapist–client relationship. Clients who require therapy, medical care, or crisis intervention will be referred to appropriate providers.

3.  Telehealth and Jurisdictional Scope

Clinical mental-health counseling services are provided by Aoife Kennedy, LCMHC, who is licensed by the New Hampshire Board of Mental Health Practice. Such clinical services are offered solely to individuals who are physically located in the State of New Hampshire, or in such other jurisdictions in which the clinician is duly licensed or otherwise legally authorized to practice at the time of service. By requesting clinical services, you represent that you are located in a jurisdiction in which we are authorized to provide them. We reserve the right to decline or discontinue services to any person located outside our authorized jurisdictions. Non-clinical coaching and educational services may be offered more broadly, subject to applicable law. Nothing on the Website is an offer to provide services where prohibited by law.

4.  Eligibility and Acceptable Use

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Website or to enter into these Terms. By using the Website, you agree that you will not:

  • Use the Website for any unlawful, harmful, fraudulent, or unauthorized purpose, or in violation of these Terms;

  • Attempt to gain unauthorized access to the Website, its servers, or any connected systems or networks, or interfere with or disrupt the integrity or performance of the Website;

We do not endorse and are not responsible for the content, products, services, privacy practices, or security of any third-party site or platform, and your use of any third-party service is governed by that third party’s own terms and privacy policy. TO THE FULLEST EXTENT PERMITTED BY NEW HAMPSHIRE LAW, IN NO EVENT SHALL THE EXISTENCE COLLECTIVE, LLC, AOIFE KENNEDY, LCMHC, OR ANY OF THEIR RESPECTIVE MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. You agree to indemnify, defend, and hold harmless The Existence Collective, LLC, Aoife Kennedy, LCMHC, and their respective members, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your access to or use of the Website, your violation of these Terms, or your violation of any right of any third party.

11.  Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or the Website shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict-of-laws principles. You agree that any action or proceeding arising out of or relating to these Terms or the Website shall be brought exclusively in the state courts of the State of New Hampshire sitting in Belknap County (the county of our principal place of business), or in the United States District Court for the District of New Hampshire, and you consent to the personal jurisdiction and venue of those courts and waive any objection based on inconvenient forum.

12.  Changes to the Website and These Terms

We may modify, suspend, or discontinue any part of the Website at any time without notice. We may also revise these Terms from time to time. When we make changes, we will update the "Effective Date" above, and the revised Terms will become effective upon posting. Your continued use of the Website after the revised Terms become effective constitutes your acceptance of the changes.
